By purchasing any ADA HERBS product, the buyer acknowledges that they have read and understood this policy. This acknowledgment is confirmed through the agreement checkbox that must be checked before completing the purchase. Any buyer engaging in activities covered by this policy is bound by its terms.
Prohibition of Unauthorized Reselling
Reselling of ADA HERBS products is strictly prohibited unless explicitly authorized under a legal contract with ADA HERBS. This prohibition applies to all individuals, businesses, and channels, including but not limited to:
Online platforms
Physical stores
Social media pages or accounts
Any other means of sale or distribution
Unauthorized reselling will result in immediate legal action, including lawsuits and other penalties.
Prohibition of Unauthorized Use of Brand Name and Accounts
The use of ADA HERBS’ brand name, logo, trademarks, or any variation thereof to create accounts, pages, websites, or any other digital or physical representation is strictly prohibited unless explicitly authorized by ADA HERBS. This includes:
Social media accounts
E-commerce store profiles
Websites or blogs
Any digital or physical platforms
Legal Implications:
Any unauthorized use of the ADA HERBS brand name will be deemed illegal and subject to immediate legal action.
Offenders will be required to cease all activities, delete any unauthorized accounts or content, and reimburse ADA HERBS for damages, including attorney fees and legal costs.
Prohibition of Unauthorized Use of Proprietary Information
The copying, distribution, or use of ADA HERBS’ proprietary information—including but not limited to product descriptions, images, marketing materials, and content—without prior written approval is strictly prohibited.
Legal Implications:
Unauthorized use of ADA HERBS’ information will be treated as an infringement of intellectual property rights.
Offenders will face legal action, including but not limited to fines, lawsuits, and reimbursement of damages.
Permitted Reselling
Reselling is only allowed for authorized partners—both individuals and businesses—who have an active, written contract with ADA HERBS. Authorized resellers must adhere to the terms outlined in their contract, including:
Pricing structures
Product bundling
Marketing guidelines
Compliance will be monitored through receipts and other methods specified in the contract. Violations will result in penalties as outlined in the agreement.
No Geographical Restrictions for Authorized Resellers
Authorized resellers may distribute ADA HERBS products globally, provided they comply with the terms of their contract regardless of location.
Returns, Warranties, and Liabilities
Returns, warranties, and product-related issues are the responsibility of the seller from whom the product was purchased. Authorized resellers must ensure that all products meet the standards specified in their contract. ADA HERBS is not liable for issues arising from unauthorized reselling or misuse of our products.
Penalties for Unauthorized Activities
Unauthorized Reselling:
Offenders must register all previously sold products with receipts.
Reimbursement for all sold amounts, plus legal fines, will be required.
Offenders will bear all attorney fees and legal costs incurred by ADA HERBS.
Unauthorized Brand Use:
Immediate deletion of unauthorized accounts, pages, or representations.
Reimbursement for damages, including potential loss of reputation or revenue.
Third-Party Responsibility:
E-commerce platforms, social media sites, or other entities facilitating unauthorized activities will also be held liable.
Penalties will be pursued through legal channels if these entities fail to take corrective actions promptly.
Enforcement and Penalties for Authorized Resellers
Authorized resellers found violating this policy or their contract terms will face penalties as outlined in their agreement. This may include termination of their reseller status and legal action.
